Nintendo is giving away the full, never before released in the U.S. (except for Donkey Kong Country 64) version of the NES Donkey Kong for 3DS Virtual Console. All you have to do to get a download code is buy and register an eligible game from the Nintendo eShop (listed in the picture) on or before 1/6/2013.
I really wish they would sell it separately. The only title that would interest me is Layton and I'm still playing through the first one. It's been so long, I should just restart it.
It's funny how they say the game has content that's never-before-seen in North America, which is technically true, but still misleading. This is actually the NES game with the cement factory level hacked back into it, so it still differs slightly from the original arcade version.

It also has the animation of Donkey Kong climbing the ladders inbetween each stage (with Pauline in tow) as he runs away from Mario (er, Jumpman?).
Hey, if anyone doesn't want the game and has an unused code, I'll buy it off of you for $5 (Paypal). I searched eBay and amazon but I didn't find any codes for sale.

In the image, in the box labeled "Special Version", it says "Donkey Kong: Original Edition has never been seen in the US and is not available for purchase."
Maybe they've been corrected since the original press release.
My only problem with this promotion is that you have to buy the games digitally. I'm going to get Paper Mario and Professor Layton, but I wasn't planning on getting the digital versions. I would get the digital version of Crosswords, but $40 is way too much money considering I still have plenty of puzzles left to do in the the original Crosswords for DS.
Maybe this promotion will apply to Animal Crossing when that comes out. Because I am definitely buying that game digitally.
Nintendo is being an ass for using tactics like this, just so people will use the digital download service. I'm not caving in, I will still buy the physical copies of the games I want from that list. Sorry Nintendo, until you lower the price of the digital versions, I will stick with the physical version. Digital versions should be at least $10 less than the physical versions. Even then, I will still stick with the physical version, cause that way, if I want to sell the game or trade it in, I still will have that option.
That makes it a more likely purchase. But I still have that darn Crosswords DS. And I just can't buy another crosswords game when I already have one that still has plenty of puzzles left to do.

In all seriousness, yes, digital versions should be cheaper since they're cheaper to produce. But on the whole, digital games are usually the same price. If you look at PS3 and 360, they cost the same as retail -- only the Vita offers a discounted price when buying digitally, and even then it's only 10% (usually $4 off of a $40 game). Nintendo doesn't want to piss off retailers, which is understandable.
I understand why you're not interested in buying your games digitally -- generally I'm not either. I think a lot of people feel the same way, and that's exactly why they're doing this promotion -- to make the digital version more appealing. If you assume that Donkey Kong would cost $5 on the eShop, and that the eligible games are $30-40, that's a better discount than you'll get on digital games on Vita or one of the other consoles.
Also, I might pick up Crosswords Plus, and if I do I'll probably do it digitally. Seems like a good game to have always in the system, and the DK bonus is a nice extra.

I recommend it if you want word games on the go. I think I like Anagrams more than Crosswords, and there are also Word Searches, weekly Crossword Puzzles, and the Word of the Day. Pretty good package for $30, and I went digitally. It won't break your SD card for space either (only 128 blocks for the initial download...not sure how much space the extra puzzles tie up, but I can't image them taking up too much space).
