It won't come straight out of the box, but an update will be available for you to perform and get the goods.

Browser too.

See, the comment came from someone at NoE. NoA, after that, responded with the following

They wouldn't go out of their way to say that unless they were thinking the service may not be available at launch in America. More like, probably not. Sure will in Europe, though!

Like I said in the other thread, I can't absolutely guarantee that it'll be available at launch because Nintendo is still working on the interface as we speak. However, my intel is directly from Nintendo of AMERICA and they're saying that it's going to be available at launch, after a system update, just like the DSi's shop channel was. So if nothing else, they plan to have it available for launch, although it is possible that they might not make it.

Either way, it's better doing it this way than delaying the hardware.
